Commitment to Purchase and Deposit

Term:  A Non refundable deposit – a deposit used to describe money that you pay that you cannot get back for any reason what so ever.
this term Non refundable deposit is also the same thing in our book as a Non refundable puppy hold.

A non-refundable deposit/ non refundable puppy hold  is required to hold a puppy/dog to use it is the same thing.
It will not be refunded if you change your mind for ANY reason!

This insures the seller that you are serious in purchasing the puppy/dog and have taken all steps to pay the balance of the puppy/dog in full.
After you agreed on a particular puppy/dog, if you change your mind about buying the puppy/dog any and all money on the puppy/dog will NOT be refunded or transferred to another puppy/dog in the litter or a different litter.

The funds paid on the puppy/dog even if the puppy is paid in full is then forfeited to the Breeder.
If you find that perfect puppy/dog and you want us to hold him/her, we ask you to send at least half down which is non-refundable.
Half down is the minimum requirement on any puppy/dog to hold unless agreed upon which is very rarely.

When you place a non refundable deposit/non refundable puppy hold down or a payment in full you also agree to all terms about deposits, and also agree to all terms of the Purchase Agreement.
If you are purchasing more than one puppy a deposit to hold both puppies is required. If you for any reason decided that you do not want both puppies the 1/2 down non refundable deposit on the other puppy that you decided not to get will be forfeited to the breeder and will not be placed on any other puppy including the puppy that you decided to keep. That is why we call it a non refundable deposit. It will not be transferred to pay the other puppy off.

If for ANY reason the Buyer does not complete the purchase including sending shipping before the puppy is 8 weeks of age, all money placed on the puppy will not be refunded or transferred to a different litter or any puppy in that litter and any funds paid on the puppy is then forfeited to the Breeder.
There is no holding of a puppy after 8 weeks of age unless there is a weather related issue and we are unable to ship.
We will only hold a puppy if agreed upon by both breeder and buyer. The price of the puppy/dog is to be paid before picking up or shipping of any puppy. If the puppy is for sale and older than 8 weeks of age, you will have up to 2 weeks to pay shipping or all funds will be forfeited to the Breeder.

If you are purchasing a puppy 6 months or adult cocker you have up to 2 weeks to pay shipping or all funds will be forfeited to the Breeder.
We are not in the business of holding puppies or adult cockers we are not a boarding facility.
We will hold them for an agreeable time frame if agreed upon.

Puppies not born yet

If you got put on a waiting list prior to the puppies being born and no puppies resulted in this breeding and put a non refundable deposit /non refundable puppy hold down your deposit is subject to this rule.
1. You can pick out a puppy out of another litter that has not been spoken for by someone else which is the same color and sex.
2. You can wait for another litter of equal quality, still needs to be same sex and color.
Breeder has the right to choose from which litter the replacement puppy will come from- depending on what we have available, some times that may take many months until we have a replacement puppy.
NO REFUNDS, only replacement puppy. If you do not pick a replacement puppy within 1 year your deposit will be forfeited to the Breeder.

If you got put on a waiting list prior to the puppies being born and the color or pattern was not produced and you put a non refundable deposit /non refundable puppy hold down your deposit is subject to this rule.
1.  You can pick out a puppy out of that litter that is not already spoken for by someone else but it must match the same sex that you oringally picked.
“Example” if you were wanting a male tri color but there is a male black/white that was available and not spoken for, if you wish that puppy could be yours.   But if you were wanting a male tri color but there is a female red/white that is available you will not be able to get that puppy unless you pay the difference.
2.   If there is not any puppies available or one in the litter that you are wanting you MUST wait for another litter of equal quality which is at the discretion of the breeder but it still needs to be same sex and color and this may take up to 6 months to a year depending on when our females produce.
Breeder has the right to choose from which litter the replacement puppy will come from- depending on what we have available, some times that may take many months until we have a replacement puppy.
NO REFUNDS, only replacement puppy. If you do not pick a replacement puppy within 1 year your deposit will be forfeited to the Breeder.

UPDATE:   As of 05/18/2017 we will no longer be taking deposits on puppies not born as we have had issues in the last month with the possible new owners not understanding all the terms of the deposits on puppies that are not born yet.    There is always one that ruins it for everyone else.   In all these years this is the first for me.

Deposits and Shipping
If you put a deposit down we only  ship through the major airlines or meet you in person.
We will not allow transportation of our puppies/dogs by providers such as Commercial Ground Transporters or any Third Party!

Payments accepted by:
No fees assessed to you by sending payment of any form will come off the purchase price of our puppies.

1.  Wells Fargo (Cheapest, Secure, Fastest Way!) 
You can go into any Well Fargo and make a deposit with Cash (reminder it MUST be Cash) into our checking account.
There is no limit on how little or how much money you are able to put in there.
I supply you with the routing # 102000076  and account # 9809974539 to our account.

You simply walk into Wells Fargo with cash in hand, ask to deposit into such account with the account information provided.
Great part it is done in minutes!  You get a receipt for your records!  It takes about a half day to actually go from pending status but we can actually see it in minutes from you placing it in there.
I give you a conformation email, text or call back letting you know it is in there.   Usually followed within 48 hours of a invoice stating how much you paid, how much is due and so on.

2.Postal Money Orders that are sent NEXT DAY (Post Office) I will then ask you to supply me with a tracking number.

We ONLY take Money Orders from the United States Post Office.
The cost is approx $1.50 per money order plus $14.95 for Next Day.

***Money Gram through (Wal-Mart) the wired type I will need a confirmation number, we do not accept Wal-Mart Money Gram Orders
We do not accept the paper type of Money Gram . There’s a fee per hundred which is to be covered by the Buyer and it must not come out of the Purchase Price.

3. Walmart Money Gram:

How to send a Money Gram:
(New Laws for Arizona only) Due to Identity Theft the State Law will only allow us to receive $499.99 per day per person)
So in many cases you will have to send it in two transactions.  One in my name and one in my husbands name.
That or them in my name and I will have to pick one up one day and one up the next day.

Different Wal-Mart have different places to go, some have a Customer Service and some have a Money Center.
If your Wal-Mart has a Money Center you need to go there. If not, you need to go to Customer Service.
Go to the counter and ask them for a Money Gram Send Form, usually it is RED in color.
Open it up and you need to specify what state that I live in which would be “Arizona”, you don’t need to put a town.

Then you will need to fill in my information for the receiver.
Then fill in how much you are sending.
At the bottom 1/2 is where you (sender) will fill in your information including your Name, Address and Telephone #
Then give it back to the Wal-Mart personal. The Wal-Mart personal will put that information into their system and will hand you a receipt.
There will be a number that you (sender) will need to provide me to pick up the Money Gram.
I will also need your information to pick it up.
Once this is sent, the money is available for me to pick up within 10 minutes.There is no waiting or worry like the Postal Service when sending a Postal Money Order.

Here’s how it will work. To make a transfer, customers will walk into a store, go to the designated “money center” or customer service desk, and fill out a form with the transfer amount, recipient’s name, and state the funds are heading to. Cash and debit cards will both be accepted for payment. Walmart-2-Walmart will then transfer the money and the person on the other end can pick the cash up at any store in the specified state within a few minutes, usually it takes 1 hour.

Customers using Walmart-2-Walmart will pay $4.50 to transfer up to $50, and a flat rate of $9.50 to transfer between $50 and the maximum of $900 per day.

5. Western Union

You can go to a place that does Western Union or you can stay in the privacy of your home and go to www.westernunion.com and send money that way using a credit or debit card, will need a confirmation number, your name & address including you phone number and how much you sent in order to pick it up. There is a fee per hundred which is to be covered by the Buyer and it must not come out of the Purchase Price.

(This is great if you want to put it on a credit card and pay monthly payments through the credit card for your new pet, but there is a HIGH fee.)

If you send a Money Gram or Western Union you will need to send me your first and last name, address and phone # used when sending the money.

**Buy placing down a non-refundable deposit/ non refundable puppy hold you understand all the terms of the deposits, agree to all the terms and willing to accept all these terms of the deposits, shipping and purchase agreement.

We do NOT take the following:
Bank Money Orders, any other type of Money Orders
Wal-Mart Money Gram Orders  (It’s the Money Order one through Walmart)
Cashier Checks
Personal Checks
Business Checks
PayPal ( I don’t even have a Paypal account)
Our bank usually puts a 30 day hold on them because they are out of State and they have to be processed and also learned that some can be cancelled after the purchase and we’d be left with no money and someone would have a free puppy.

 

If you send a type of payment that is not allowed, it will be returned back!

Final Payment of the puppy, if you are picking up by meeting me will need to be paid in CASH only.

Note: by placing a non refundable deposit down or a payment in full you also agree to all terms about deposits, and also agree to all terms of the Puppy Contract Agreement.   No puppy/dogs will be held without a non refundable deposit. To be fair to each person all puppies/dogs will be sold to the first loving family who sends a deposit to hold a puppy.

What if something happens to my puppy prior to shipping?
If your puppy/dog does not require shipping and you are driving to pick up your puppy /dog a deposit is still required to hold a puppy.   If you put a non refundable deposit down or a payment in full and something happens to the puppy prior to shipping or meeting the money will not be refunded.
For an example, the puppy displays a cherry eye and needs to be fixed or show signs of any other health issue, some times new born puppies do pass away due to many reasons including mom’s laying on them or they just don’t make it, this does happen often just examples and covering what if’s.
There is no refund of the purchase price! This is a replacement guarantee only.
The breeder reserves the right to a possible waiting times of 1 year or more to make the replacement, as puppies are not always available. The replacement puppy will be of the same quality, sex and color originally purchased unless agreed otherwise. The replacement puppy will be selected by the breeder from the next available litter.  

 

Our Right to Refuse
We have the right to refuse sale to any puppies/dogs or provide services to any person at any time for any reason even if you have placed a deposit on a puppy/dog or payment in full. I had bought a dog or puppy but you decided not to sell the puppy to me after placing a deposit or full payment. We have the right to refuse sale to any puppies/dogs or provide services to any person at any time for any reason even if you have placed a deposit on a puppy/dog or payment in full. Some of the reasons for this are to include but not limited to. Puppy didn’t clear health certificate, do not think puppy is ready to go, health issues, attachment issues, decided we want to keep. Including if we start talking to you more and we are not feeling comfortable with the sale, feel like there are red flags, or have an uneasy feeling.
Including finding information that was not disclosed prior to the sale or during the sale process, like you say you have two dogs and you have 10, etc..For any reason we decided to not sell you a puppy or dog your deposit or payment in full will be returned to you.
If you put down a non refundable deposit or payment in full your money will be returned to you once the puppy has been resold.
This may takes weeks or months, but as soon as it is done it will be returned.

****If the puppy or dog is still here after they are 8 weeks of age and they are for sale, you will need to put a non refundable deposit of at least half down to hold the puppy or dog. The rest of puppy or dog purchase price including shipping is due within 2 weeks. If for ANY reason the Buyer does not complete the purchase before the 2 weeks is up, all money placed on the puppy will not be refunded or transferred to a different litter or another puppy or dog. Any and all funds paid on the puppy or dog is then forfeited to the Breeder. There is no holding the puppy or dog after the 2 week date unless agreed upon.****
Shipping Money
Shipping also needs to be paid in full before the puppy is 7 weeks of age so shipping arrangements can be made. Breeder will not hold a puppy if shipping is not paid in full by 7 weeks of age or otherwise agreed upon.    If it is not paid in full, no money will be refunded and all funds paid on this puppy will then be forfeited to the Breeder.  Please continue to the shipping page.
